Gym Registration & Liability Waiver

1. Acknowledgment of Risk

I acknowledge that participation in gym activities, including but not limited to strength training, cardiovascular exercise, use of equipment, and group classes, involves inherent risks. These risks include, but are not limited to, muscle strains, sprains, fractures, heart-related conditions, slips and falls, equipment malfunction, and other serious injury or death.

I understand that these risks may arise from my own actions, the actions of others, or the condition of the facility or equipment.

2. Assumption of Risk

I voluntarily assume full responsibility for any risks, injuries, losses, damages, or expenses that may occur as a result of my participation in gym activities.

3. Release of Liability

To the fullest extent permitted by applicable Alberta law, I hereby release, waive, and discharge the facility, its owners, directors, officers, employees, contractors, trainers, agents, and affiliates (collectively, the “Releasees”) from any and all claims, demands, damages, costs, or causes of action, including those arising from negligence, breach of contract, or breach of any duty of care, arising out of or related to my use of the gym or participation in its activities.

4. Medical Fitness

I confirm that I am physically capable of participating in gym activities and have no medical condition that would prevent safe participation. I acknowledge that the facility does not provide medical advice and that I should consult a physician prior to participation if I have any concerns.

5. Equipment Use

I agree to use all equipment properly and in accordance with posted instructions and staff guidance. I understand that improper use of equipment increases the risk of injury.

6. Rules and Conduct

I agree to follow all facility rules, policies, and staff instructions at all times. I understand that failure to comply may result in suspension or termination of my access without refund.

7. Indemnification

I agree to indemnify and hold harmless the Releasees from any and all claims, demands, damages, or expenses (including legal fees on a solicitor-and-client basis where permitted) arising from my actions, omissions, or use of the facility.

8. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada.

9. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

10. Acknowledgment and Consent

I confirm that I have read and understood this Agreement in its entirety. I am aware that by signing this document I am waiving certain legal rights, including the right to sue, to the extent permitted by law. I sign this Agreement voluntarily and without inducement.
